As the legal parent or guardian of the participant named below, or as an adult participant, I acknowledge and agree to the following:

I understand that participation in any activity offered by XCEL 360, LLC, including but not limited to 360 Sports Centre, Cheer Kingdom, and Motion Park (“360 Sports Centre Entities”)—including but not limited to tumbling, cheerleading, stunting, trampoline, gymnastics, parkour, ninja, dance, camps, open gym, private lessons, and birthday parties—involves inherent risks of physical activity, including serious injury, permanent disability, or death.

I understand that these risks cannot be completely eliminated even when reasonable care is exercised.

In consideration for allowing myself or my child(ren) to participate in programs or use the facilities, I hereby:
- Assume all risks associated with participation;
- Waive, release, and forever discharge XCEL 360, LLC and its officers, directors, agents, employees, contractors, landlords, and affiliates from any and all claims, demands, causes of action, or liability whatsoever, including those arising from the negligence of the released parties (except gross negligence or intentional misconduct);
- Covenant not to sue or bring any legal action against the released parties;
- Agree to indemnify and hold harmless the released parties from any and all claims, including legal fees and costs, arising from participation or use of the facilities by myself or my child(ren).


This is a continuation of the 360 Sports Centre Assumption of Risk, Waiver, and Release of Liability Agreement. Please read the following carefully before signing.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN:
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE 360 SPORTS CENTRE ENTITIES USE REASONABLE CARE, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY THAT CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR AND YOUR CHILD’S RIGHT TO RECOVER FROM THE 360 SPORTS CENTRE ENTITIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, OR PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE 360 SPORTS CENTRE ENTITIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN.
